Judge delays Damien Gilliams’ case against Sebastian recall group

Judge Janet Croom ruled Friday that Sebastian City Clerk Jeanette Williams was not served properly for the Damien Gilliams’ lawsuit.

The summons was served to the wrong person at the City of Sebastian, who is not authorized to accept legal documents.

As a result, a summons was re-issued and served to Williams Thursday. Since there was a delay, Judge Croom set a Sept. 2 deadline for Williams to respond to the lawsuit.

If the case is not dismissed by Sept. 2, Gilliams’ lawsuit will be heard on Sept. 8.

The special election to recall Damien Gilliams, Pamela Parris, and Charles Mauti is still planned for Sept. 15.
