A Florida construction company has dismissed its lawsuit against Damien H. Gilliams and his wife, Bonnie F. Gilliams, after the parties resolved a dispute over unpaid work on a lift station at their No Name Sports Bar in Sebastian.
Southeast Services of the Treasure Coast Inc. filed a notice of voluntary dismissal with prejudice Thursday in Indian River County Circuit Court, ending the case filed less than a month earlier. The dismissal means the claims cannot be refiled, and each side will bear its own legal fees and costs.
“Plaintiff, SOUTHEAST SERVICES OF THE TREASURE COAST, INC., through undersigned counsel gives notice that Plaintiff and Defendants were able to resolve the dispute and that pursuant to Rule 1.420(a)(1)(A), Fla. R. Civ. P., Plaintiff files this notice of the voluntary Dismissal of the claims against Defendants, DAMIEN H. GILLIAMS, and BONNIE F. GILLIAMS in this action with prejudice with each party to bear its own attorney’s fees and costs,” the notice states.
The lawsuit, filed July 24, stemmed from a February 2024 contract for Southeast Services to install a lift station at No Name Sports Bar, located at 490 U.S. Highway 1 in Sebastian. The company alleged it completed the work by March 6, 2025, but Gilliams failed to pay $26,740 of the $48,490 total cost.
In response, Gilliams disputed the claim, telling Sebastian Daily that the work remains incomplete. “Like all contractors, when you complete the job, that’s when you get paid. As of today, it is still incomplete,” he said after the lawsuit was filed.
Court documents included claims of breach of contract against Damien Gilliams and foreclosure on a construction lien against both defendants. Southeast Services sought damages, interest, costs, and attorney fees, along with a potential judicial sale of the property if unpaid.
The resolution avoids a trial in the civil matter. No further court dates are scheduled.
