The District Court of Appeal has denied Damien Gilliams’ motion to expedite his court case in attempting to stop the recall election.
On Sept. 8, Circuit Judge Janet Croom dismissed a case in the lower courts.
However, Gilliams has threatened to take the recall group and PAC founder Tracey Cole all the way to the Supreme Court.
The recall election will be certified today at 5:00 p.m., officially removing Gilliams as a Councilman.
Gilliams can still try to take the case again to the District Court of Appeal, but it will take several months and be very costly.
Legal experts familiar with the appeal process tell Sebastian Daily Gilliams’ case will go nowhere.
In addition, Gilliams is being accused of harassing and threatening the recall group through the entire process. After being recalled Tuesday night, Gilliams made more threats of coming lawsuits.
Gilliams still has a lawsuit against City Manager Paul Carlisle and Mayor Ed Dodd. However, Gilliams’ lawyer, Craig Rappel, has filed a motion to withdraw as counsel.
Bob McPartlan, Christopher Nunn, and Fred Jones will take their seats on Wednesday, Sept. 23, 2020, during the regular City Council meeting.
