VERO BEACH – A consumer is taking two Vero Beach debt collectors to court alleging they violated the law.

Patricia A. Klein, who resides in Indian River County, filed a class-action lawsuit on Nov. 30 in the U.S. District Court for the Southern District of Florida against McKinnon & Hamilton PLLC and Charles W. McKinnon.

Klein says the plaintiff violated the Fair Debt Collection Practices Act. She alleges that in 2016, she suffered damages from receiving threats of a lien filed against her by the defendants if she did not submit payment within 30 days, according to the complaint.

Klein holds McKinnon & Hamilton PLLC and McKinnon responsible for damages because the demand for payment allegedly overshadows her rights to a 30-day dispute under the FDCPA. She would have to mail a check before the 30 days expiration for them to receive it to meet the debt collector’s demands.

She is seeking statutory damages, all legal fees and interest plus any other relief as the court deems just, according to court documents.
