A former Arby's employee in Vero Beach is suing for overtime wages.

VERO BEACH – A former Arby’s employee in Vero Beach has filed a class action suit alleging she was only paid straight time for overtime work.

Tamara Dalbey filed the suit on behalf of others similarly situated on March 13 in the U.S. District Court for the Southern District of Florida against T.T.K.M. Inc., doing business as Arby’s, and Thomas Lureau citing the Fair Labor Standards Act.

The class action suit alleges the plaintiff was employed at the Vero Beach fast-food restaurant from March 2014 to February 2017. The plaintiff holds the company responsible for failing to pay overtime premiums at a rate of time-and-one-half of her regular rate of pay.

According to court documents, the plaintiff requests a trial by jury and seeks unpaid overtime wages. Also, the plaintiff seeks liquidated damages, all legal fees, interest, and any other relief as this court deems just.
