VERO BEACH – A man was arrested at the Ay Jalisco Restaurant in Vero Beach after he balled up his fists as he tried to walk out without paying his bill.

Phillip Russell, 42, walked into the Mexican restaurant Tuesday night and consumed a pitcher of beer ($13.38) before trying to leave without paying.

The restaurant manager approached Russell and asked whether he intended to pay his bill before leaving. Russell then became belligerent with the manager and stated he already paid, according to the report.

The Vero Beach Police Department made contact with Russell and told him he had to pay the bill. He appeared extremely intoxicated as he stood near the bar.

Russell refused to pay the bill because he had no money, according to the report. When questioned why he ordered the drinks when he had no money, he became angry and balled up his fists.

Russell was arrested and transported to the Indian River County Jail where he was charged with Defrauding Innkeeper.

On February 10, Russell was arrested for violating a no-contact order in Vero Beach.
