VERO BEACH – The Vero Beach Police Department received a call from The Stamp, a bar on 13th Avenue, about one of their patrons passed out drunk in the men’s room.

Officers made contact with the bar manager who said the subject has been passed out for over an hour and they wanted him out of the bar.

Peter Durning, 55, was seen passed out while sitting on the toilet.

“Durning was passed out sitting on the toilet and was so heavily intoxicated he could not comprehend any instructions,” according to the report.

It took three officers to remove him from the establishment. Durning told police that he had an active warrant for Failure to Appear on a Trespassing, which was verified after a records check.

Durning was transported to the Indian River Medical Center for clearing, and then to jail.

While at the Indian River County Jail, officers located a small baggie of marijuana (approximately 2 grams) from inside a jacket Durning was wearing.

“I don’t have any marijuana, oh wait someone gave me that,” Durning said when officers showed him the small baggie.
